Who Exercises Casting Vote In Rajya Sabha? Casting Vote In Rajya Sabha

 

We often hear equality of votes as part of the process of Parliament. Equality Of Votes means equal votes. What this means is that after any bill is debated in the Lok Sabha or Rajya Sabha, whether the bill is passed or not depends on the voting. If the majority supports it, the bill will pass. Or the bill will be rejected.   In some cases, when both the yes and no votes are equal, it is called Equality of Votes. And when Equality Of Votes comes, how will a decision be made? That is called deciding a vote. In English it is called Casting Vote or Deciding Vote.

 But who has this power in the Lok Sabha? In the past many exams have asked who has the power to cast the deciding vote. What is the answer — Speaker.


 See the Speaker of the Lok Sabha comes and becomes a member of the Lok Sabha. This means that a member of the Lok Sabha is elected and elected as Speaker. After taking charge as Speaker he has to act impartially. Even if he belongs to the government, he should not speak in support of the government, speak against the government, or speak against the opposition. The Speaker is responsible for treating all parties equally!!


So normally when the bill is debated and voted then the speaker does not have the power to vote. What the speaker does is monetize/supervise. He has to see whether the voting process is done properly or not. In such a case the speaker has no power to vote ❌️


 But when the votes come, In case of equality of votes, then the Speaker will vote. ✅️

  •  That is, as per the Speaker's vote, it is decided whether the bill will be passed or rejected, so it is called a deciding vote. It is a process in Lok Sabha.


How can such a situation come to the Rajya Sabha?

  • The Chairman appears in the Rajya Sabha like the Speaker in the Lok Sabha. But the Speaker of the Lok Sabha must be a member of the Lok Sabha. Only a member of the Lok Sabha can be elected as the Speaker of the Lok Sabha. No one else can be.

  •  But as far as the Rajya Sabha is concerned the Chairman of the Rajya Sabha is not a member of the Rajya Sabha.


 So what does this mean? According to the constitution, after a person is elected as the Vice President, he will assume the duties of the Chairman of the Rajya Sabha, ex officio chairman.


 Then if that person is a Rajya Sabha member but wins as Vice President then that Rajya Sabha seat becomes vacant. So not a member of that assembly. And he is not a member of the Rajya Sabha, but acting as the Chairman. All the work done by the Speaker in the Lok Sabha should be done by the Chairman in the Rajya Sabha.


 The Speaker casts the deciding vote in their Lok Sabha. He has power because he is a member of the Lok Sabha.


 But while coming to the Rajya Sabha, the Chairman of the Rajya Sabha is not a member of the Rajya Sabha. Can we cast a deciding vote? This means that the Constitution has given the power of casting the deciding vote to the Chairman of the Rajya Sabha in relation to the Rajya Sabha. Very very important 📌

And the chairman is not a member of Rajya Sabha!! And who gave the power to cast a decisive vote, that is, it was given by the Constitution.
